Map the complete article and intended use
Create a bill of substances and components for inner and outer metal, plastic lid parts, silicone gaskets, straws, valves, coating, ink, adhesive, lubricant if any, handle, accessories, packaging, and labels. Identify direct food contact, foreseeable indirect contact, mouth contact, external handling, and non-contact roles. Record supplier, grade or formulation, color, batch control, and applicable evidence.
Define intended beverages, acidity, alcohol or fat where relevant, hot or cold fill, maximum temperature, contact duration, repeat use, cleaning, age group, and destination. Regulatory suitability can depend on food type and conditions of use. The same polymer or coating should not be assumed suitable for every temperature and beverage merely because it appeared in another bottle.
Understand the US food-contact route
In the United States, food-contact substances that meet the definition of a food additive generally need an applicable authorization, effective food-contact notification, regulation, threshold exemption, or other lawful basis for the intended use. FDA resources distinguish the substance, material, and finished article and connect authorizations to specified uses and limitations. The responsible business should verify each component through qualified regulatory review.
Avoid a broad ‘FDA approved bottle’ statement unless its exact meaning and basis are defensible. FDA does not provide one universal finished-drinkware badge. Maintain supplier declarations, formulation or identity controls, applicable regulatory citations or notification basis, conditions of use, test reports where appropriate, and change control. Check current FDA databases and guidance because legal status can be supplier- and use-specific.
Build the EU and member-state evidence matrix
Regulation (EC) No 1935/2004 provides the EU framework for materials and articles intended to contact food, including general safety, traceability, and labeling principles. Additional EU measures, good-manufacturing rules, material-specific legislation, national requirements, and guidance may apply. Plastics, ceramics, metals, coatings, inks, adhesives, silicone, and mixed articles do not all follow one identical test package.
LFGB testing is frequently requested for Germany or as a commercial benchmark, but the buyer should specify the legal and test scope rather than treating ‘LFGB’ as a worldwide certificate. Confirm declarations, migration or extraction conditions, sensory requirements where applicable, traceability, labeling, languages, and the responsible operator for each destination. Separate REACH and California Prop 65 decisions
REACH addresses chemicals in the EU and can create duties around restricted substances, Candidate List substances in articles, communication, notification, or other controls depending on concentration, use, role, and facts. A generic screening report is only one input. Track materials, suppliers, current candidate and restriction lists, report detection limits, exemptions, and change dates with qualified expertise.
California Proposition 65 is a warning law with a state-maintained chemical list and exposure-based analysis; it is not a universal product-pass certificate. Determine whether the product creates an exposure requiring a warning, what evidence supports the decision, which party is responsible, and what current warning content and sales-channel process apply. Do not copy another brand’s warning or rely only on a ‘Prop 65 test’ label.
Qualify BPA-free, lead-free, and similar claims
A BPA-free statement should identify which plastic, resin, coating, liner, or complete product it covers and whether intentional use, analytical testing, supplier declaration, or another basis supports it. It does not mean free of every bisphenol or chemical. Lead-free, PFAS-free, non-toxic, eco-friendly, and food-safe likewise require precise definitions, thresholds, scope, evidence, and legal review.
Match each claim to the exact SKU, color, component suppliers, manufacturing process, intended use, test method, laboratory, date, result, and market. Review marketing, product page, packaging, instructions, and sales documents together. A cautious accurate claim is more valuable than an absolute phrase that the evidence cannot support.
Maintain technical files and change control
Store the final BOM, drawings, supplier identities, material declarations, applicable authorizations or regulatory basis, laboratory reports, samples, risk assessments, labels, instructions, traceability plan, inspection records, and approvals. Create an evidence matrix showing requirement, component, document, sample identity, issue date, expiry or review date, owner, and gap. Reconcile the file before production release.
Require notice before changes to grade, resin, gasket, colorant, coating, ink, adhesive, lubricant, supplier, mold, facility, use, packaging, or claim. Conduct a documented impact review and obtain updated evidence or testing. Monitor official regulatory changes in target markets and recheck marketplace policies. Compliance is a lifecycle process, not a packet collected once during supplier onboarding.
